I have a position with a county government. On March 1,2012 my department will be privatize. A manage care company will be taking over. Today I was told I will be laid off as of March 1, 2012. I have been on STD since January 28, 2012, with a RTW date of March 5, 2012. I was not offered a position with the new company.
What are the legal obligations of my current employer? I have been employed since 1999 - full time.
Can they stop my STD benefits/health insurance with the lay off notice?
Are they obligated to keep my position open till I return to work?
Am I obligated to take a position with the new company?
I would like to stay with the county so I can keep my health insurance and STD/LTD benefits due to continued treatment. I am worried about my income.
Do I have any protection with the American Disabilities Act?
