Workplace Politics
I am writing today in pursuit of legal guidance regarding my situation, to gain understanding if there is actual cause to take further legal action to help get further compensation. I am a fashion industry professional, Design Director.
My History:
I was diagnosed in December 2015 with Stage 1C ovarian cancer and am currently working on seeking further treatment options.
I was just let go from my job this past Tuesday to which I was told was due to restructure.
I had to have 2 separate operations; 12/1 super cervical hysterectomy to remove what was thought to be a massive fibroid was actually diagnosed later as cancer. 12/22 Full Hysterectomy and complete staging.
During the time of my operations and recovery my boss went ahead and discussed my medical issues with people in the company completely disregarding my privacy and right to tell anyone of my condition at my own will. However I did not confront her or HR regarding this matter as I was not educated that this is actually an invasion of my rights.
I returned to work on 1/6/2016 to which I was told that am not to work on the new seasonal line, that she has it covered. I am just to observe. I later had a conversation with her approximately 1 week later after which I met to confront and discuss with her that she embarrassed me in a team meeting with outspoken passive/ aggressive remarks. I expressed that she is not treating me fairly and, that it is actually mentally beneficial to me to work and have a purpose while I am dealing with my health issues. I explained to her that my health issues will not impact my performance.
She retreated and let me continue on a somewhat normal work basis however her attitude toward me changed. She became hostile and dismissive, purposely leaving me out of meetings which I should have been involved in. Additionally, there was a complete loss of face time with her. Subsequently when there was any face time with her the hostility and tension was very apparent to me and all involved and there was usually a passive/ aggressive comment made to embarrass or undermine me somehow.
This continued and in February she actually verbally attacked me before a sales meeting over something minor which was I had a dress tailored in order for us to send overseas to help clarify how the garment should be executed for production. Unfortunately there were no witnesses to my knowledge to this incident but it has affected me mentally.
To further explain, during this entire time my boss had brought in a person under the guise of "consultant" which is actually a former colleague and personal friend of hers. Which I now understand has been now gainfully employed into the company working for her.
I received an agreement and release for 4 weeks compensation and continuation of heath benefits via COBRA. I do not want to jeopardize the compensation they are willing to give me however I feel I should receive compensation of an additional 4-8 weeks for my mental anguish and would like to know if this is worth pursuing to gain the additional monetary compensation on my own or via a lawyer.
I need to send my signed confirmation back to HR within 4 days. I am in somewhat of an urgent situation.
