Hi Everyone! My husband was diagnosed with AML in 2016. He relapsed in late 2017 and had a stem cell transplant. He has been on disability since his diagnosis with occasional part time work during 2017 while he was in between treatments. His disability policy with his current position has been amazing. We, however, are thinking about moving closer to family and we both have great job offers close to family. My question is can a new job's disability (short and long term) deny coverage for a pre-existing condition if they say you can sign up without evidence of insurability as a new hire? I'm wondering if (God forbid) my husband were to relapse again or need time off for treatment related side effects can they deny paying him disability once they get medical records and see he has been dealing with this for a long time? I'd appreciate any knowledge or experience anyone has with this. Thank you!

Hi Tina,
Thanks for writing to us. First of all, congratulations on the amazing job offers! You’ve asked really important questions about your husband’s disability coverage as you both figure out your next steps. Since CAC doesn’t currently have an in-house legal expert, my immediate recommendation is that you reach out to the Cancer Legal Resource Center to discuss the specific details of your husband’s situation and determine a course of action. They are a nonprofit that provides pro-bono counseling on legal and insurance issues and might have advice about how to approach the situation. Their contact information is listed below:

You might also consider reaching out to your local Bar Association to see if they have any helpful resources listed:
