Hello,
I'am a Cancer survivor and I am changing jobs but I just realized if I quit my current job I will be with out insurance for 90 days that is my waiting period in the new company. I do not know what to do, I know if I apply to a private health insurance they can reject my application or is the Obama care in effect already? Please advice

Hi Kathy,
Thank you for reaching out. I have sent your question to our legal expert who will get back to you within a week or so. Our National Conference is tomorrow so we're a little swamped right now, apologies for the delay.

Hi Kathy,
Your best bet is to take COBRA even though it will be expensive during your 90 day waiting period as you don't want to be without insurance or you will face a pre-existing condition exclusion period from your new insurance. The provisions in the new healthcare law regarding being able to purchase insurance on the open market through exchanges and not being able to be denied coverage due to a pre-existing condition don't take effect until 2014.
Hope this helps while we wait for a more complete response from one of our legal experts.
Best,
Rebecca
